Illegal Alien, Wanted for Attempted Murder in Brazil, Deported After Being Released into US by Biden Admin

If convicted for attempted homicide, De Oliveira faces up to 30 years in prison.

An illegal alien wanted for attempted murder in Brazil was deported last month by U.S. Immigrations and Customs Enforcement (ICE) after federal authorities located the fugitive hiding in Massachusetts, according to a Monday press release by ICE.

Felipe Augusto De Oliveira, a 23-year-old Brazilian national illegally crossed into the U.S. near Lukeville, Ariz., in March of 2023, ICE said.

De Oliveira, who was wanted by Brazilian authorities for the charge of attempted homicide, was apprehended by U.S. Border Patrol officials, but was issued a notice to appear before a Department of Justice immigration judge and released into the U.S. on an order of recognizance.

ICE issues orders of recognizance as an “Alternatives to Detention” program for illegal immigrants who have been arrested and placed in removal proceedings.

According to the Department of Homeland Security (DHS), certain migrants subject to ongoing removal proceedings are issued orders of recognizance and released from custody because they are “not a detention priority.”

ICE said they confirmed De Oliveira’s presence in Massachusetts, and deportation officers from ICE’s Enforcement and Removal Operations (ERO) Boston arrested him on May 2 in Lowell, Mass.

“Felipe Augusto De Oliveira attempted to use our Massachusetts communities to evade an attempted homicide charge in his home country,” said ERO Boston Field Office Director Todd Lyons.

“Now he has been returned to Brazil to face justice there. We cannot allow the world’s criminals to use our New England neighborhoods as hideouts from the law,” Lyons said. “ERO Boston will continue to prioritize public safety by apprehending and removing egregious noncitizen offenders.”

The Brazilian fugitive was ordered removed from the U.S. by a Department of Justice immigration Judge on July 1, and he was flown back to his home country and turned over to Brazilian authorities on July 26.

If convicted for attempted homicide, De Oliveira faces up to 30 years in prison.
