Venezuelan Gang Member ‘running free’ in NYC for Weeks After Ignored Detainer, Finally Arrested by ICE

A member of Venezuelan transnational criminal organization Tren de Aragua was free in New York City for three weeks in September before being arrested by federal immigration enforcement despite his conviction on a felony firearm possession charge.

U.S. Immigrations and Customs Enforcement (ICE) on Wednesday announced the arrest of Javier Jose Albornoz Marchan, a 22-year-old illegal alien from Venezuela. Albornoz was taken into custody on Staten Island, N.Y., on Sept. 28.

According to ICE, Albornoz first entered the U.S. illegally near El Paso, Texas, on Sept. 22, 2022, when he was apprehended by U.S. Border Patrol and paroled into the country.

Albornoz never reported to ICE Enforcement and Removal Operations (ERO) for processing after his entry into the U.S., ICE said.

Within months of crossing the border illegally, Albornoz was arrested in June 2023 in New Jersey for shoplifting. A local court remanded Albornoz’ charges and released him on his own recognizance.

On Jan. 6, 2024, the Woodbridge, N.J., Police Department arrested Albornoz for shoplifting and the burglary of tools.

An immigration detainer lodged against Albornoz at the time was ignored by the Middlesex, N.J., County Jail, and the illegal alien was released from custody without notification to ICE.

In March 2024, Albornoz was one of eight noncitizens arrested by the New York City Police Department (NYPD), and was charged with multiple counts of criminal possession of a firearm, criminal possession of a controlled substance with intent to sell and acting in manner to injure child less than 17.

Shortly after his March arrest, ICE again lodged an immigration detainer against Albornoz with the New York Department of Corrects at Rikers Island.

On Sept. 5, the Bronx County Supreme Court convicted Albornoz of criminal possession of a firearm and sentenced him to six months of imprisonment.

The next day, however, the N.Y.C. Department of Corrections ignored the ICE immigration detainer and released Albornoz back into the community.

ICE ERO eventually located and arrested Albornoz on Sept. 28 after the FBI New York’s Safe Streets Task Force notified ICE of possible threats made by Albornoz to local law enforcement and requested assistance with taking him into custody.

“Sanctuary jurisdictions undermine public safety and put our communities at unnecessary risk,” said ERO New York City Field Office Director Kenneth Genalo in a Wednesday statement.

“New York City and state leaders should reevaluate the policies that prevent local law enforcement from cooperating with ERO,” Genalo said. “It is unconscionable this felon was running free in New York for the last three weeks when he could have immediately been apprehended upon release from local custody.”

“Thankfully, through the due diligence of our courageous officers and our law enforcement partners, this individual was swiftly apprehended and denied the ability to reoffend,” he added.
