Baldacci Wants to Remove Marijuana from Criminal Code As Illegal Chinese Cannabis Invades Penobscot County

Baldacci did not respond when asked if his bill would impair law enforcement's ability to deal with the Chinese criminal organizations proliferating in rural Maine.

Maine’s legislature will consider a bill proposed by Sen. Joe Baldacci (D-Penobscot) that would remove all references to marijuana from Maine’s criminal code when it re-convenes in January.

“This bill removes marijuana from the Maine Criminal Code by doing the following:
removing marijuana being listed as a scheduled drug; eliminating the crime of unlawful trafficking in marijuana,” said Sen. Baldacci.

The bill, LD 1789, would remove all marijuana related crimes and expunge all criminal records related to marijuana as Maine struggles to clamp down on the hundreds of Illegal Chinese cannabis grows discovered throughout the state.

On Thursday, for example, three Asian men — believed to be non-citizens — were charged with Class B felonies for illegally growing more than 2,700 cannabis plants at a house in Machias.

Were Baldacci to get his way, it’s unclear whether those charges would still be available to law enforcement.

Although recreational and medical cannabis use is legal in Maine, some marijuana related crimes remain in the state’s criminal code, and unlicensed cultivation of marijuana remains illegal.

The bill is a carry-over from the previous session of the legislature, and will be considered in January alongside other carry-over bills.

Baldacci’s bill will be considered after the state’s legislative council rejected a proposal by Rep. Michael Soboleski (R-Phillips) which would have empowered law enforcement to combat the Chinese marijuana cultivation sites.

One bill related to the illegal, foreign-owned cannabis sites in Maine, from Rep. John Andrews (R-Paris), did make it through the legislative council.

Baldacci did not respond when asked if his bill would impair law enforcement’s ability to deal with the Chinese criminal organizations proliferating in rural Maine.

    …just a formality with Jackboot Janet’s Legislative Regime. LEO’s hands seem to be tied already because they are afraid to act on the other illegal Chinese grows. There are laws already being subverted for the regime! (are the LEOs too afraid to confront the Chinese for fear of retribution or they might lose donut time?)
