DeSantis OKs Florida Squatter Crackdown

Gov. Ron DeSantis (R-Fla.) signed a bill Wednesday meant to combat the growing national scourge of squatting — that is, sneaking into people’s homes and refusing to leave.

“On so many issues, what New York does, what California does, we will do the opposite,” said Gov. DeSantis.

“Now in Florida, you call up, you fill out a form, sheriff comes, and the sheriff kicks them out of your property,” DeSantis said.

Squatters have made headlines from New York to Portland, Oregon in recent weeks as outraged property owners find themselves unable to remove unwanted occupiers or, even worse, are arrested for attempting to execute and eviction.

In some states, such as New York, authorities have sided with squatters over the lawful homeowners.

Under the new law, Florida homeowners can file a request with law enforcement, and, if someone is illegally staying in their home, and the squatter has ignored the landowner’s requests that he leave, law enforcement will remove the squatter from the property.

Unlike many states, in which the rightful property owner is forced to engage in expensive, lengthy litigation for a chance to regain his home, Florida homeowners can have confidence that police will remove the criminals, and that they will be able to reclaim their property in a timely manner.

The new bill does not allow landowners to oust tenants without due process if the tenant has a legitimate lease and the two parties are engaged in a legal dispute.

The law also implements harsher criminal penalties for squatters, making it a class A felony for someone to attempt to sell a property which he does not legally own, and a class B felony for anyone who does more than $1,000 worth of damage to a property in which he squatted.

    During legislative session in 2023 the Speaker of the House ultra radical special interest Talbot-Ross sponsored a bill that would give someone trespassing into your house certain rights if they said they were looking for shelter. Amazingly, ‘somehow’ common sense prevailed as surprisingly enough Democrats refused to go along with it. She withdrew her bill as not enough would vote for it.

    This is the type of leadership that the Democrat House members voted to be their Speaker of the House. Voting or Not Voting for who represents your district does have Severe Consequences.
