Federal Judge in NH Moves to Impede Deportation of Guatemalan Illegal Arrested in Massachusetts

New Hampshire U.S. District Judge Joseph N. Laplante ruled on Wednesday that the Trump administration must give 72 hours’ notice before transferring a Guatemalan illegal immigrant arrested in Massachusetts out of the NH facility where he is currently held.

The illegal immigrant, Juan Francisco Mendez, 29, was arrested by Immigration and Customs Enforcement (ICE) agents in New Bedford, Massachusetts, last week and is currently being held in the Strafford County House of Corrections in Dover, NH.

ICE agents smashed the windows of Mendez’s car after he and his wife refused to open the door on request. The incident was caught in a now-viral video that has drawn outrage from many on the left.

Mendez’s wife and lawyers have maintained his innocence of any crimes and stated that he was in the midst of asylum application proceedings. His wife claimed that the ICE agents were actually looking for someone else.

Despite statements from Mendez’s wife and lawyers, ICE has maintained that its agents acted appropriately.

“During the course of his arrest, he refused to comply with officers’ instructions and resisted apprehension. ICE concurs with the actions deemed appropriate by the officers on the scene who are trained to use the minimum amount of force necessary to resolve the situation in a manner that ensures the success of the operation and prioritizes the safety of our officers,” said ICE.

The agency also revealed that Mendez had previously been served with a notice to appear before an immigration judge.

Judge Laplante’s order seems to be an attempt to hinder any efforts to remove the illegal immigrant from the U.S. The 72-hour warning could give time for the stay of removal applied for by Méndez’s lawyers to be granted.

Mendez appears poised to become another illegal immigrant icon, like Kilmar Abrego Garcia, an MS-13 terrorist and alleged wife beater who was deported back to his home country, El Salvador. Left-wing media outlets maintained that Garcia was unjustly deported and that he was simply a loving husband and father, despite multiple judicial rulings that found him to be a likely member of MS-13, and testimony from his wife alleging domestic abuse.
