Left-wing DA Faces Misconduct Complaint Over Oakland Woman Who Alleged She Was Drugged, Sexually Assaulted at Waterville Bar

Kennebec and Somerset County District Attorney Maeghan Maloney is currently facing allegations before the Maine Board of Overseers of the Bar concerning her conduct with respect to an Oakland woman who has alleged she was drugged and sexually assaulted in a Waterville bar.

The complaint against Maloney was first reported by Keith Edwards of the Kennebec Journal, a “Maine Trust for Local News” newspaper.

Last year, Pamela Boivin of Oakland filed a complaint with Maine’s Board of Overseers of the Bar alleging that District Attorney Maloney improperly reached out to one of Boivin’s friends who works for the Family Violence Project, offering to share confidential information about the investigation into her alleged assault, as well as a separate criminal case against her.

According to Boivin, this was allegedly done in an attempt to bypass her attorney in seeking a plea deal and to silence her online criticism of authorities for not thoroughly investigating or prosecuting her alleged assault.

Maloney has denied these allegations — both in an interview with the Kennebec newspaper and in a motion filed with the Board of Overseers — explaining that she did nothing wrong, as she says she only reached out to the woman at the Family Violence Project because Maloney thought the woman could help Boivin cope with her experiences.

The District Attorney goes on to say that she did not provide any confidential information to the woman who ultimately declined Maloney’s request for help.

Contrary to Maloney’s claims, Boivin has suggested that the woman from the Family Violence Project is not a “victim’s advocate” as the District Attorney claimed but rather that she primarily works as a domestic abuse educator in schools. Boivin goes on to allege that Maloney instead contacted her because of her friendship with Boivin.

Boivin has alleged that she was drugged, sexually assaulted, and robbed on Easter Sunday at a Waterville bar in 2023, before being found by police in her car where she was unable to answer any questions or follow simple commands.

That same day, she was arrested on Route 139 in Fairfield after her car was seen swerving. She was charged with operating under the influence, failing to stop, and refusing to sign a uniform summons and complaint, according to Somerset County Sheriff Dale Lancaster.

The Kennebec Journal goes on to report that Sheriff Lancaster said Boivin had not reported her assault to deputies.

Social media posts from Boivin later that month indicated to the contrary that she had told police she had been assaulted on the day she was arrested, alleging that law enforcement did not take her report seriously and refused to update her about the progress on her case.

According to the Kennebec Journal, no sexual assault case has been brought on Boivin’s behalf.

With respect to the criminal charges filed against her, Boivin eventually pleaded guilty to operating under the influence, while the other charges against her were dismissed.

“I want the mass drugging and raping of women in Waterville, Maine, to be investigated,” Boivin said, according to the newspaper. “I want answers to the significant discrepancies in my rape ‘investigation’ and in all those that came before me and after me. This has been going on for years and these victims of drug-facilitated rapes deserve justice.”

Waterville Chief of Police William Bonney reportedly told the outlet in response to Boivin’s allegations that there is no evidence to support the existence of “rape rooms” in Waterville as she suggests.

The owner of the bar where Boivin has said she was assaulted has denied that such an incident happened there and has threatened legal action if she continues to make such accusations about his establishment publicly.

“I reached out to ask a victim advocate to contact an alleged sexual assault victim, something I have done in many, many cases,” Maloney said, according to the Kennebec Journal. “The only purpose of my reaching out [to the woman at Family Violence Project] was to help Ms. Boivin with her underlying complaint of sexual assault.”

“When sexual assault allegations do not lead to a suspect, a victim advocate is even more important than when a criminal case proceeds,” Maloney continued. “The Waterville Police Department did everything possible to investigate her case, but Ms. Boivin remains upset that there is no one against whom criminal charges can be brought. Like in many other cases, I have referred victim advocates to victims in cases where we could not prove the allegations.”

According to a petition from an attorney for the Board of Overseers, an initial investigation by a Board Committee found that there is probable cause District Attorney Maloney violated rules for professional conduct and recommends that the Board’s Grievance Commission hold a hearing to consider disciplinary action against her.

Former Maine Supreme Judicial Court Justice and attorney Joseph Jabar is representing Maloney against the allegations before the Board and has argued that the Committee’s findings are flawed.

According to Jabar, Maloney acted appropriately within her role as a prosecutor when she reached out to the woman at the Family Violence Project, as she was concerned for Boivin’s well-being after reading her posts online regarding how the alleged assault and lack of investigation had impacted her.

Jabar went on to argue that the Board should dismiss the case against Maloney without holding a hearing, as he feels she was only trying to help Boivin, not silence her.

“The conspiracy, that’s all background noise, the real issue is whether Maeghan was legally allowed to refer the case to an advocate for her help, which she does all the time,” Jabar said, according to the newspaper. “I don’t understand why they’re proceeding versus a district attorney who acted in compliance with the law and should be cleared.”

Both Jabar and Boivin have reportedly said that a hearing before the Board has not yet been scheduled.

According to the Kennebec newspaper, Jabar and Maloney have sought an order to force Boivin to remove her posts online sharing the documents filed with the Board of Overseers, as Jabar has said they are confidential until the process moves into a public phase. Action has reportedly not yet been taken on this request.
