The Bangor Police Department responded to a State Street apartment at approximately 8:38 a.m. when the tenant reported that he had awoken to find a man sleeping on his couch and refusing to leave.

Officers arrived and quickly identified the alleged trespasser as Jose Harvey, 50, of Milford, based on his previous interactions with law enforcement.

According to police, Harvey could not provide them with a logical reason for why he was in the apartment.

After the police responded, the tenant found that all his doors were locked, but his bathroom window had been opened and all his Christmas presents had been unwrapped near where Harvey was found.

Police took Harvey into custody and transported him to the Penobscot County Jail, where he was charged with aggravated criminal trespass.
