A former two-time Maine gubernatorial candidate, previously convicted of possessing child porn, is now being charged with violating probation by looking for an escort online.
A probation officer overseeing former gubernatorial candidate Eliot Cutler has filed a motion to revoke Cutler’s probation, according to the Ellsworth American.
Cutler, 79, formerly of Cape Elizabeth and now living in Brooklin, allegedly violated the terms of his probation this fall by accessing sexually explicit content online and by possessing unmonitored devices, the paper reports, quoting documents filed in Hancock County Superior Court.
Cutler two years ago pleaded guilty to four counts of possessing sexually explicit material of a minor under the age of 12.
Judge Robert Murray sentenced Cutler to four years in jail with all but nine months suspended on each count. He only ended up serving seven and a half months.
But Cutler was also placed on probation, due to end in 2030.
The probation included a requirement that he not use electronic devices to access the Internet without being monitored.
But he appears to have violated that condition by going online and connecting to a San Francisco-based massage parlor looking for an escort.
The website contained a menu on which Cutler answered questions about his desired preferences in an escort, Probation Officer Sam Payson wrote in a criminal affidavit.
An affidavit is a document in which law enforcement authorities spell out alleged criminality to try to persuade a judge that sufficient evidence exists to formalize a charge for a trial.
The conditions of Cutler’s probation prohibit him “from accessing any Internet websites known to depict persons engaging in sexual acts or sexually explicit conduct or depicts sexually explicit materials, obscene or sexually explicit conduct.”
He is scheduled for a court hearing December 16.
Cutler ran for governor twice as an “independent,” losing by less than two points in 2010 and by a wider margin in 2014.
