Salvadoran Sentenced After Entering the Country Illegally After Two Prior Deportations

A Salvadoran illegal immigrant was sentenced on Wednesday after re-entering the country illegally following two prior deportations.

Helmer Osmin Gutierrez, 43, of El Salvador, was arrested in October after he was pulled over for a traffic violation in Farmington.

The Farmington police officer requested assistance in identifying the four men in the vehicle.

The Border Patrol agent identified the other three occupants and Gutierrez. A field immigration inspection determined that Gutierrez was an El Salvadoran citizen with no documentation showing that he was legally present in the U.S.

Immigration records confirmed that Gutierrez had been deported from Miami, Florida, in 2008 and again from Chandler, Arizona, in 2010.

U.S. District Judge John A. Woodcock, Jr., sentenced Gutierrez to time served. He has been incarcerated since October 18, 2025.

Though he was only sentenced to time served, he will likely face deportation.

He did not appear as a detainee on ICE’s inmate locator website as of Thursday night.
