Nigerian National Convicted of Sex Crime Against Child in Rhode Island After Overstaying Visa Arrested by ICE

An unlawfully present Nigerian national who was convicted of indecent solicitation of a Rhode Island child after overstaying a tourist visa has been arrested by U.S. Immigrations and Customs Enforcement (ICE) agents, the agency announced Monday.

According to ICE, deportation officers apprehended the 45-year-old Nigerian sex offender on Thursday, Feb. 15, in Rumford, Rhode Island.

ICE said the Nigerian national entered the U.S. into New York City on a non-immigrant tourist visa in May 2017.

He violated the terms of his tourist visa by remaining in the U.S. beyond the time authorized, according to ICE.

The Nigerian national was arrested by Rhode Island State Police in July 2019 on the charge of indecent solicitation of a child, which under Rhode Island state law refers to a person soliciting child sexual abuse material, creation of obscene material, prostitution, or sexual conduct with a minor — a felony and sex offense.

The Nigerian man was convicted of the offense in May 2022 in Rhode Island’s Providence Superior Court and was sentenced to five years in prison with six months of home confinement. The court then suspended four and a half years of the sentence, ICE said.

When ICE Enforcement and Removal Operations (ERO) Boston learned of the Nigerian sex offender’s presence in their area of responsibility, they located and arrested him without incident.

His arrest came as one of 275 arrests by ICE of unlawfully present non-citizen sex offenders nationwide between Feb. 5 and Feb. 16.

The Nigerian citizen will be held in ICE custody pending a removal hearing before a Justice Department immigration judge.

“Rhode Island is safer with this noncitizen sexual offender off of the streets,” ERO Boston Field Office Director Todd Lyons said. “His presence in the community posed a threat to public safety.

“ERO Boston remains committed to prioritizing the removal of egregious predators from our New England communities,” Lyons said.
