A Salvadoran national who is a documented member of the notorious MS-13 transnational criminal street gang, and who was previously deported from the U.S., has been arrested by federal immigration authorities in Massachusetts after being charged with multiple counts of assault and battery.

According to U.S. Immigrations and Customs Enforcement (ICE), the 28-year-old Salvadoran first entered the U.S. illegally in November 2014 near Rio Grande Valley, Texas, after which he was given a notice to appear before an immigration judge for removal proceedings.
In June 2016, nearly two years after his release into the country by border agents, he was arrested in Chelsea, Mass., on a charge of carrying a dangerous weapon or knife with a length over four inches.
The Salvadoran national was then ordered to be deported from the U.S. to El Salvador by a Department of Justice immigration judge in August, 2017 — a decision which the Salvadoran appealed, resulting in ICE releasing him on an order of supervision in May 2018.
ICE uses orders of supervision to release detained immigrants who have received or are awaiting an order of deportation on certain conditions, which often include immigrants being required to report regularly to an immigration officer, wear a GPS tracker, and needing permission to travel.

The Salvadoran national’s order of supervision was revoked in October 2021 after he was arrested by ICE agents in Catonsville, Maryland, and he was deported from the country to El Salvador later that month.
ICE said that the Salvadoran gang member later illegally reentered the U.S. at an unknown date and location without being inspected by immigration officials.
On May 2, 2023, the MS-13 gang member was arrested by the Chelsea, Mass. Police Department, and ICE lodged an immigration detainer against him.
The Chelsea District Court refused to honor the immigration detainer, resulting in the gang member being released on bail a week later on May 9, 2023.
The Salvadoran national was arraigned in Chelsea District Court on Nov. 21, 2023, on charges of assault and battery on a police officer, resisting arrest, and assault and battery on a family or household member.
Despite another immigration detainer being lodged against the MS-13 gang member, the court system ignored the detainer and released him, ICE said.

On March 28, 2024, deportation agents with ICE Enforcement and Removal Operations (ERO) Boston arrested the 28-year-old Salvadoran national near his residence in Chelsea, Mass.
He will remain in custody pending another removal hearing before a DOJ immigration judge.
“This Salvadoran noncitizen was not only a member of a violent street gang. He was a threat to our Massachusetts residents,” said ERO Boston Field Office Director Todd Lyons in a Wednesday press release.
“We are constantly on these streets apprehending the worst of the worst,” Lyons said.
“ERO Boston will continue to prioritize public safety by arresting and removing the most egregious noncitizen offenders from our New England communities.”
