Lame-duck President Joe Biden’s administration is making changes to policies governing illegal immigrants already in the U.S., according to sources speaking to the New York Post, potentially hindering President-elect Donald Trump’s mass deportation plans.
“This is an obstructionist transition,” said former Acting Customs and Border Protection Commissioner Mark Morgan, speaking to the Post.
“What they’re trying to do in the last final day, they’re going to try to put up as many roadblocks and obstacles and throw as many grenades as they can on their way out,” he added.
Anonymous sources inside the Department of Homeland Security (DHS) reportedly told the Post that the Biden administration will allow “asylum seekers” who entered the U.S. illegally to check in through a forthcoming Immigration and Customs Enforcement (ICE) app.
Currently, asylum seekers in the U.S. with pending asylum hearings are required to check in with ICE periodically.
ICE agents use those checks to keep tabs on illegal immigrants, check their criminal histories, and look for any outstanding arrest warrants.
Sources claimed that the new app, scheduled to roll out in New York City starting in December, is unreliable and, unlike the in-person check-ins, does not look for outstanding warrants.
It reportedly does not function at all on Android phones and fails to collect GPS data on laptops.
The current system requires migrants to provide proof of address, but the new app reportedly will not interface with the current CBP system.
DHS sources believe that the new app check-in system will help illegal immigrants evade authorities, as President Trump plans to implement large-scale deportations.
They claimed that 100,000 illegal immigrants will be enrolled at the start of the program.
Sources told the Post that the new immigration program is an attempt by President Biden to preemptively thwart Trump before he comes into office.
Along with implementing the new app, the Biden Administration is reportedly trying to alter ICE’s “Alternatives to Detention” program to allow illegal immigrants to appeal tracking measures such as ankle bracelets.
Sources told the Post that a migrant in the program will be able to request to be removed from the program entirely and will be able to make a legal appeal if his request is denied.
The change in immigration rules is just the latest move by President Biden that appears calculated to leave Trump with a difficult situation.
On Monday, he authorized Ukraine to strike Russian territory with American-made missiles—an explicit red line for Russia—risking a nuclear response from the superpower.
That decision, if it does not lead to nuclear Armageddon before Trump’s inauguration, is sure to impede his plan for a quick peace between Russia and Ukraine.
