Two illegal aliens previously released into the U.S. under the Biden Administration are in federal custody after allegedly shooting an off-duty Customs and Border Protection (CBP) agent in the face and arm in New York City on Saturday.

“An incredible CBP officer was shot in the face by an illegal Alien Monster freed into the country by Joe Biden. He was apprehended at the border in April, 2023, but, instead of being deported, was RELEASED. The CBP Officer bravely fought off his attacker, despite his wounds, demonstrating enormous Skill and Courage,” said President Donald Trump Sunday on Truth Social.
“The Democrats have flooded our Nation with Criminal Invaders, and now, they must all be thrown out or, in some cases, immediately prosecuted in that we cannot take a chance that they are able to come back. That’s how evil and dangerous they are,” Trump added.
The off duty agent was in Fort Washington Park when he was approached by two illegal immigrants on a scooter. According to a woman who was with the agent at the time, they were sitting by the water when the passenger on the scooter approached the agent with a firearm drawn.
The CBP agent drew his firearm in self-defense when approached by the armed illegal, Miguel Francisco Mora Nunez, who then allegedly opened fire.
Video released by the DHS shows the altercation, and appears to show the two illegals escaping on their scooter after the shooting.
“Our CBP Officer in NYC showed extraordinary courage last night – shot in the face by an illegal alien & still fought back to help bring his attacker into custody. This violent criminal never should’ve been on our streets. This is exactly why we fight every day to secure this nation. We’re praying for the officer & his family,” said CBP Commissioner Rodney Scott.
The Department of Homeland Security (DHS) believes the attack was an attempted robbery rather than a targeted attack on a CBP agent.
Nunez, a Dominican national, reportedly shot the agent twice, once in the cheek and once in the arm. DHS agents arrested him one day after the shooting, on Sunday.
He has a lengthy rap sheet, including a New York arrest for felony grand larceny in 2023, an October 2024 arrest for assault, November 2024 and January 2025 arrests for criminal contempt, and a February armed robbery arrest warrant in Leominster, Massachusetts. Nevertheless, Nunez was not removed from the country, and apparently incurred no apparent penalties for his crimes.
He first entered the U.S. illegally in April 2023, and was released into the country under the Biden Administration. A final removal order was issued for his deportation in November 2024, but Nunez nevertheless remained in the country.

On Monday, the DHS apprehended the scooter’s driver, Cristian Aybar Berroa, an illegal alien Dominican who entered the U.S. in 2022, and was released on immigration parole.
He also has a lengthy rap sheet, with a 2023 reckless endangerment arrest, and two separate grand larceny arrests in New York in 2024. During those arrests, Berroa was subject to an Immigration and Customs Enforcement (ICE) detainer, but was nevertheless released.
This February, he was arrested for reckless endangerment, reckless driving, and for driving without a license, and, just last month, he pled guilty to petite larceny at the Bronx County Supreme Court, and was once again released onto New York streets.

“These violent thugs had committed a smorgasbord of crimes and been arrested multiple times and yet New York continued to release them, ignore an ICE detainer and allow them to continue to prey on Americans and terrorize our streets. How many people have to die, how many lives have to be changed forever for Mayor @ericadamsfornyc and his sanctuary politician ilk to end these performative politics,” said Assistant DHS Secretary Tricia McLaughlin.
The shooting comes amid a drastic uptick in violence against immigration authorities, with recent examples including an organized armed assault on an ICE detention facility in Texas and the alleged attempted murder of ICE agents.
In response to the uptick in violence, Rep. Jared Golden (D-Maine) along with Rep. Don Bacon (R-Nebraska) put forward a bill that would significantly increase penalties for anyone attacking federal agents like immigration authorities, including provisions to secure the death penalty for anyone who kills law enforcement officers.
