A Brazilian national charged with raping a minor in Massachusetts has been arrested by U.S. Immigrations and Customs Enforcement (ICE) agents after he fled to Portland, Maine.
According to ICE, the Brazilian national along with his mother and father were apprehended by Border Patrol in July 2021 after crossing the U.S.-Mexico border illegally near San Luis, Arizona.

The Brazilian noncitizen and his family were then served with a notice to appear before a Department of Justice Immigration judge, and were released on an order of recognizance.
Orders of recognizance allow for the release of detained migrants into the country under certain conditions during ongoing immigration court hearings.
The Brazilian national was arrested in Billerica , Mass., in August 2023 for the offenses of unlicensed operation of a motor vehicle and no inspection sticker — those charges were later dismissed, ICE said.

On Dec. 20, 2023, the Milford, Mass. Police Department issued a warrant for his arrest on the charges of rape of child and enticement of a child under 16.
The Brazilian noncitizen was then arrested by the Portland, Maine Police Department on Jan. 10, 2024, for the offense of fugitive of justice stemming from the warrant issued by Milford Police.
ICE Enforcement and Removal Operations (ERO) Boston lodged an immigration detainer against the Brazilian national with the Cumberland County Jail, which was later provided to the Worcester, Mass. County Sheriff’s Office upon transfer of the Brazilian national back to Massachusetts.
The Brazilian was transported to Milford District Court in Mass. on Jan. 18, 2024, and arraigned on the child sexual abuse offenses.
The alleged child rapist was then released from custody after paying $5,000 in bail due to the Milford District Court failing to honor the ICE immigration detainer.

Deportation officers from ERO Boston apprehended the 20-year-old Brazilian noncitizen March 28 near his residence in Lowell, Massachusetts.
A video of the arrest was captured and posted to X by Fox News national correspondent Bill Melugin.
ICE agents told Melugin that they had arrested four alleged child rapists and one MS-13 gang member on the morning of March 28 alone.
“This Brazilian noncitizen is accused of sexually abusing a Massachusetts minor,” said ERO Boston Field Office Director Todd Lyons in a Monday press release. “Every second he spends roaming free in our communities, he represents a potential threat to the children of our communities.”
“The men and women of ERO Boston will always prioritize public safety by protecting the residents of New England from egregious noncitizen offenders,” Lyons said.
The Brazilian noncitizen will remain in federal custody pending the resolution of his local charges, before undergoing removal proceedings before a Justice Department immigration judge.
