A Guatemalan national living illegally in the U.S. since at least 2011 has been arrested by U.S. Immigrations and Customs Enforcement (ICE) after being charged in June with forcibly raping a Massachusetts child.
Deportation officers with ICE Enforcement and Removal Operations (ERO) Boston were able to track down and apprehend the illegal alien in Lowell, Mass. in late September, after he was released from custody by a local court that refused to honor an immigration detainer.
According to ICE, 38-year-old Guatemalan national Maynor Francisco Hernandez-Rodas entered the U.S. illegally at an unknown date and location, what is commonly referred to as a “gotaway.”
Hernandez has a criminal history in the U.S. dating back to 2011, when he was convicted and served a six-month prison sentence in Connecticut for breach of peace. He was convicted of the same offense in 2016, also in Conn., for which he was issued a $100 fine.
On June 14, 2024, the Lowell, Mass. Police Department arrested Hernandez on charges of aggravated rape of a child and rape of a child with force.
ICE says that while they lodged an immigration detainer against Hernandez on June 28, the Middlesex Superior Court ignored the detainer and released Hernandez from custody at an unknown date.

Officers with ERO Boston arrested Hernandez Sept. 20 in Lowell. Hernandez remains in ERO custody.
“Maynor Francisco Hernandez-Rodas stands accused of horrific crimes against a Massachusetts child,” said ERO Boston acting Field Office Director Patricia Hyde.
“He represents a significant danger to the children of our community that we will not tolerate,” Hyde said. “ERO Boston will continue to prioritize public safety by arresting and removing egregious noncitizen threats from our New England neighborhoods.”
