Illegal MS-13 Gang Member Released into US Under Biden Admin Arrested by ICE in Boston

A member of the international crime gang MS-13 who illegally entered the U.S. and was released into the country under the Biden administration was arrested by federal immigration officers in Boston last week.

U.S. Immigration and Customs Enforcement (ICE) announced on Wednesday that Enforcement and Removal Operations (ERO) Boston took 19-year-old Guatemalan national Luis Adolfo Guerra-Perez into custody in Boston on Jan. 22.

“Luis Adolfo Guerra-Perez is an illegally present gang member, who has shown complete disregard for American laws,” said acting Boston Field Office Director Patricia Hyde on Wednesday.

“He is a member of a violent street gang charged with illegally possessing a high-capacity firearm and drugs,” Hyde said. We will not tolerate such offenders to threaten the residents of our New England neighborhoods. ERO Boston will continue to arrest and remove egregious alien offenders from our communities.”

According to ICE, Guerra entered the U.S. illegally on March 21, 2021, over the southern border. He was given a notice to appear before an immigration judge, and was released into the country by ERO Dallas on an Order of Recognizance — an alternative to migrant detention — on May 8, 2021.

Guerra was ordered removed from the U.S. by a Department of Justice immigration judge on Oct. 2, 2024. Regardless of that order, he appeared to have remained at large for several months until he was arrested on other criminal charges in New England earlier this month.

The Guatemalan illegal alien was arraigned in the East Boston District Court on Jan. 3 for the charges of possession of a large capacity firearm, possession of a class D controlled substance, possession of a firearm without a permit and possession of ammunition.

Despite ICE lodging an immigration detainer against Guerra, he was released from custody by the East Boston District Court on Jan. 21.

However, he was again apprehended by ICE the following day on Wednesday, Jan. 22. He will remain in ERO custody pending his deportation to Guatemala.
