Maine Man Accused of Lacing Ice Cream with THC at New Hampshire Cafe

A Maine man is facing up to ten years in prison after being indicted on federal charges for allegedly lacing ice cream with tetrahydrocannabinol (THC) at a New Hampshire cafe.

Marc Flore, 43, was indicted on one count of tampering with consumer products, Assistant U.S. Attorney for the District of New Hampshire Jay McCormack announced Thursday.

In charging documents, federal prosecutors accuse Flore of lacing a batch of coffee-Oreo flavored ice cream with THC — a schedule I controlled drug that is the psychoactive chemical of cannabis — at the Roots Local Cafe and Catering in Newmarket, New Hampshire in March of 2023.

Prosecutors say the ice cream was then sold to consumers at the café.

At the time of the incident, Newmark Police said they received reports of several unrelated patrons checking themselves into regional hospitals for various symptoms including severe dizziness, weakness, and exceptionally high heart rates.

Newmarket Police said the customers feeling ill were those that consumed “Angelo’s Amore” brand ice cream.

In a message posted to their Facebook page following the incident, Roots Cafe said they are no longer getting ice cream from Angelo Amore’s and cooperating with police in their investigation.

“Roots Cafe is no longer getting ice cream from Angelo Amore’s and is cooperating fully with all involved,” Roots Cafe said.

“We cannot believe or understand how this happened. Angelo’s Amore is no longer in business and Roots Cafe had no part in making of this ice cream. We are saddened by this news for those involved, as well as outraged that this could happen to anyone,” they said.

We are fully cooperating with the Police and assure you that all his ice cream has been removed from this store. Our deepest apologies to all involved and we promise we will do everything in our power to make sure this never happens to anyone ever again,” they added.

If convicted, Flore faces a maximum sentence of up to ten years in prison, up to three years of supervised release and a fine of up to $250,000.

The investigation of this case was led by the food and Drug Administration Office of Criminal Investigations and was assisted by the Newmarket Police Department.

Flore will appear at a federal court in Concord at a later date, the New Hampshire U.S. Attorney’s Office said Thursday.

    Anyone that thinks you can “accidentally” lace a batch of ice cream that causes dizziness, weakness and accelerated heart rate to multiple people is likely the village idiot. Or using chinese drugs. Or both.

    Please allow those affected to be in a locked room for 10 minutes with Mr. Flore prior to his court appearance. The ambulance should be gassed up and ready to go.
