Illegal Alien Facing 9 Counts of Child Sex Crimes Arrested by ICE After Being Released by MA Court

The 33-year-old Guatemalan national will remain in ICE custody pending an appearance before a Department of Justice immigration judge for removal proceedings.

U.S. Immigrations and Customs Enforcement (ICE) agents in Boston have arrested an unlawfully present Guatemalan national who has been charged with multiple sex crimes against minor victims in Massachusetts.

ICE deportation officers with Enforcement and Removal Operations (ERO) Boston apprehended the 33-year-old Guatemalan illegal alien on Thursday, March 28, near his residence in Lynn, Mass.

“This unlawfully present Guatemalan national has been charged with sex crimes against Massachusetts children,” said ERO Boston Field Office Director Todd Lyons. “His very presence in our community represents a dire threat to our residents.”

“ERO Boston will continue to prioritize public safety by arresting and removing any such threat to the people of New England,” Lyons said.

According to ICE, the Guatemalan national entered the U.S. at an unknown date and location, without inspection by an immigration official.

The Guatemalan national was previously arrested in March 2022 on charges of assault and batter on a household member, strangulation/suffocation charges, and reckless endangerment of a child, ICE said.

In February 2023, the Lynn District Court dismissed all charges against the Guatemalan noncitizen.

He was arraigned again on June 26, 2023, in the East Boston District Court in Boston, Mass., on charges of compulsory insurance violation, number plate obscured/not displayed/concealed ID, and forgery — all charges against the Guatemalan national were dismissed by the court on the same day.

The Guatemalan was arraigned for a third time on Nov. 8, 2023, in Lynn District Court on charges of three counts of indecent assault and battery on a child under 14; assault to rape child; two counts of assault and battery on child with injury; and intimidation.

A week later, on Nov. 15, 2023, the Guatemalan was arraigned again on in Lynn District Court on the charge of indecent assault and battery on a child under 14.

According to ICE, on Feb. 27, 2024, the Lynn District Court dismissed all indictments against the Guatemalan national for an arraignment in the Essex Superior Court.

On Feb. 26, 2024, the Guatemalan illegal alien was arraigned in Essex Superior Court on nine counts of indecent assault and battery on a child under 14, rape of a child, two counts of assault and battery, and intimidation of a witness.

Although ERO Boston lodged an arrest warrant and immigration detainer against the Guatemalan noncitizen Nov. 20, 2023, with the Essex County Correctional Facility in Middleton, Mass, ICE said that at an unknown date the Mass. Court System refused to honor the detainer and ordered the release of the Guatemalan noncitizen.

The 33-year-old Guatemalan national will remain in ICE custody pending an appearance before a Department of Justice immigration judge for removal proceedings.
