After reports of a biological man using the women’s locker room at a Missouri Life Time Fitness, the state’s Attorney General Andrew Bailey (R) announced on Friday that he will be investigating the commercial gym chain for “putting Missouri’s women and girls in harm’s way.”
According to the St. Louis Post-Dispatch, the controversy stems from a 52-year-old biological man named Eris Montano who on Monday was confronted by a female gym-goer at an Ellisville, Mo. Life Time Fitness for using the women’s locker room.

In a Facebook post by Montano that sparked outrage among conservatives on social media this week, Montano described the encounter with the woman, who she described as “very Karen.”
“Sounds like I caused quite the commotion at the gym by being trans in the ladies locker room yesterday,” Montano wrote. “A woman (very Karen) confronted me in the locker room this morning saying it was inappropriate for me to be in there.”
“I answered every challenge when she eventually accused me of having ‘parts’ with little girls being around when the reality is that no one is ever naked in there and neither am I,” Montano continued.
Montano said that after a meeting with the general manager of the Life Time Fitness that “the club is on my side and will attempt to educate their membership.”
In an interview with the St. Louis Post-Dispatch, Montano said she identifies as a “real woman” and began “transitioning” about two years ago, including multiple surgeries and taking medication for the past 12 months.
A Life Time Fitness spokesperson told the outlet “that there are varying opinions regarding locker room access. As a company, we are committed to following the law in every area we operate with respect to public accommodation.”
“Life Time is committed to providing safe, welcoming and respectful environments,” the spokesperson said. “To the extent we receive reports of conduct inconsistent with our club policies, we review and address them.”
In his Friday letter to Bahram Akradi, CEO of Life Time Fitness, Inc., Missouri Attorney General Andrew Bailey wrote “It has come to my attention that Life Time Fitness has proudly adopted a policy that permits biological men to use locker rooms designated specifically for women and young girls.”
“Even more concerning is the fact that instead of taking the safety concerns from your gym members seriously, you rudely correct them and insist they call this biological male by the ‘correct pronouns,'” Bailey continued.
“While it might be considered fashionable in certain corporate boardrooms to pretend that biology is irrelevant, the American heartland still lives in reality,” he added.
Attorney General Bailey cited Missouri case law indicating that a “male’s presence in a females’ public restroom constitutes criminal trespass,” and claimed that the gym chain’s policies “are potentially enabling criminal behavior.”
Bailey said that he is issuing subpoenas and that Life Time Fitness will face potential criminal and civil liability for “putting Missouri’s women and girls in harm’s way.”
