Biden Admin to Allow an Additional 309,000 Haitian Migrants to Seek Temporary Protected Status in US

Department of Homeland Security (DHS) Secretary Alejandro Mayorkas announced on Friday that the Biden administration will be allowing up to 309,000 Haitian migrants currently living in the U.S. to seek Temporary Protected Status (TPS), which will prevent them from being deported from the U.S.

According to the DHS, the redesignation and extension of TPS for the Haitian migrants is due to “humanitarian challenges” on the island nation, including an ongoing gang violence crisis that led to the resignation of Haitian Prime Minister Ariel Henry in April, following a massive jailbreak.

“We are providing this humanitarian relief to Haitians already present in the United States given the conditions that existed in their home country as of June 3, 2024,” said Secretary Mayorkas on Friday. “In doing so, we are realizing the core objective of the TPS law and our obligation to fulfill it.”

The redesignation will allow an estimated 309,000 additional Haitian nationals who arrived in the U.S. on or before June 3, 2024, to apply for TPS — effectively shielding those migrants from deportation, even if they originally entered the U.S. illegally.

Haitian migrants who are granted TPS will also be able to apply for employment authorization documents and travel authorization.

The extended application period for the Haitian migrants will last a period of 18 months, from Aug. 4, 2024, to Feb. 3, 2026.

The U.S. previously extended TPS to Haitian nationals who were living in the U.S. before the 2010 earthquake.
