AG Frey Sues USDA Over Freeze on Federal Funding Following Maine’s Refusal to Ban Males from Girls’ Sports

Maine Attorney General (AG) Aaron Frey added to his growing list of lawsuits against President Donald Trump’s administration on Monday when he announced the state has filed suit against the U.S. Department of Agriculture (USDA) for freezing some of its education funding to Maine.

“Under the banner of keeping children safe, the Trump Administration is illegally withholding grant funds that go to keeping children fed. This is just another example where no law or consequence appears to restrain the administration as it seeks capitulation to its lawlessness,” said AG Frey.

“The President and his cabinet secretaries do not make the law and they are not above the law, and this action is necessary to remind the President that Maine will not be bullied into violating the law,” he added.

The lawsuit came less than a week after the USDA announced a freeze on some federal education funding for Maine, following the state’s refusal to comply with Title IX federal antidiscrimination laws by preventing transgender-identifying males from competing in girls’ sports.

The USDA warned that, if Maine does not comply with federal rulings, it will continue to cut more education-related funding, but vowed that it would not cut programs dedicated to feeding needy children.

Frey’s lawsuit alleges that, despite the department’s assurances, the Maine Department of Education (MDOE) was unable to access “several sources of federal funding, all of which are necessary to feed children and vulnerable adults.”

His complaint claimed that the funding freeze will leave children hungry, though it is unclear if any schools have stopped providing food to needy children as a result of the funding freeze.

Frey argued that the freeze did not follow legally required procedures and that the USDA did not have unilateral authority to rescind funds approved by Congress.

Maine could have all of its funding restored immediately if the state and entities under its aegis stop allowing males into women’s sports, but Gov. Janet Mills (D-Maine), the MDOE, and the Maine Principal’s Association have all obstinately refused to comply with federal law.
