Former twice-failed gubernatorial candidate and convicted sex offender Eliot Cutler is denying the latest charge of violating probation.
Cutler, 79, appeared in court this week facing police claims that he failed to receive the sexual-addiction treatment that was part of his conviction plea deal.
The disbarred lawyer was convicted of possessing child porn in 2023 and served eight months in jail before being released early for “good behavior.”
He was arrested again this month for allegedly violating conditions of his release.
Several adult pornographic DVDs and a DVD player were allegedly found in Cutler’s room after a search in South Portland.
Cutler allegedly told officers that he “can’t help himself” and “has had this problem for 65 years.”
It is a violation of his recent terms of release to possess, access or view any pornographic material.
That was the third time in recent months that Cutler has been accused of violating his probation.
Now, he is facing a fourth alleged violation for being “unsatisfactorily discharged from court ordered specialized problematic sexual behavior treatment.”
Court records show that Cutler was discharged because he is incarcerated and unable to take part in treatment.
Cutler’s parole officer has recommended that Cutler be returned to jail to serve out the rest of his four-year sentence.
“Mr. Cutler has demonstrated that he has no intent of following his ordered conditions and is simply searching for ways to circumvent them,” Cutler’s probation officer Sam Payson wrote in a violation review form. “It is obvious that he does not intend to take advantage of probation and treatment, therefore probation will not be a benefit.”
Cutler’s next court hearing is set for April 8.
